The Trump Administration has signaled a significant shift in the management of federal lands onshore and on the Outer Continental Shelf for energy development. Multiple Executive and Secretarial Orders, Congressional Review Act resolutions, and ongoing litigation involving Obama Administration energy sector regulations have set in motion several energy-based initiatives across multiple agencies.

Join Beveridge & Diamond principals Jamie Auslander and Peter Schaumberg to discuss current opportunities and challenges for the development of energy and mineral resources under the new Administration. Among other hotly debated topics, they will cover the role of climate change considerations in decision-making, potential changes in mitigation requirements, issues regarding royalty valuation and payment, and still unresolved issues regarding the scope of Presidential withdrawal authority onshore and offshore under decades-old statutes.

Our Speakers:

Peter J. Schaumberg is a principal with Beveridge & Diamond, P.C. in Washington, D.C. His practice focuses on issues related to development of energy resources on the Outer Continental Shelf and on federally-managed lands onshore, including oil & gas, solar, wind and geothermal resources, as well as development of coal and hard-rock mineral resources on public lands. He also advises clients with respect to royalty reporting and payment issues for federal mineral leases offshore and onshore, and for Indian leases. Mr. Schaumberg joined Beveridge & Diamond in 2006 after 25 years with the Office of the Solicitor, Department of the Interior. He was the Deputy Associate Solicitor for Mineral Resources, the senior career attorney responsible for providing legal advice to the energy, minerals and royalty programs of the Minerals Management Service (now the Bureau of Ocean Energy Management, the Bureau of Safety and Environmental Enforcement, and the Office of Natural Resources Revenue) and the Bureau of Land Management.

Jamie Auslander co-chairs Beveridge & Diamond’s Natural Resources and Project Development Practice Group, including its Energy practice. Mr. Auslander focuses his practice on complex legal issues surrounding development of oil and gas, hardrock minerals, renewable energy, and other natural resources on public lands onshore and on the Outer Continental Shelf. He frequently works with the Department of the Interior agencies and prosecutes appeals before the Interior Board of Land Appeals regarding royalty, suspension, decommissioning, regulatory departures, and other issues. He also assists multinational corporations, domestic companies, and leading industry trade associations in protecting valuable lease rights and navigating the ever-changing environmental requirements to develop those leases. Mr. Auslander also devotes a significant part of his practice to counseling and litigation under the National Environmental Policy Act (“NEPA”).
